These Terms and Conditions ("Terms") govern your use of projectjoymachine.com and any purchase you make from Project JoyMachine ("JoyMachine," "we," "us," or "our"). By accessing the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.

1. Eligibility and Acceptance

You must be at least 18 years old, or the age of majority in your state, to purchase from the site. By using the site you represent that the information you provide is accurate and that you will not use the site for any unlawful purpose. We may update these Terms at any time; changes are effective when posted, and your continued use means you accept them.

2. Products, Pricing, and Availability

We work to keep product descriptions, fitment, images, pricing, and availability accurate, but errors happen. Colors and finishes may appear differently on your screen than in person. We reserve the right to correct errors, change or discontinue products, and limit quantities at any time without notice. Prices are in U.S. dollars and are subject to change. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order, even after it is placed, and will refund any amount charged.

3. Vehicle Fitment and Compatibility

Performance and aftermarket parts are application-specific. Fitment listings, charts, and recommendations are provided as guidance only and are not a guarantee of compatibility with your specific vehicle, configuration, or other modifications. You are responsible for confirming that a part fits your year, trim, and build before purchase and installation. When in doubt, contact us with your vehicle details before ordering. Parts ordered incorrectly are subject to our Return Policy, including the restocking fee.

4. Off-Road, Competition, and Emissions Compliance

Some products we sell are intended for off-road, closed-course, or competition use only and are not legal for use on public roads or highways. Certain parts may not be legal for sale or use in California or other states, or on vehicles operated on public roads, and may affect or void your vehicle's emissions compliance and warranty.

You are solely responsible for knowing and complying with all federal, state, and local laws, including emissions and noise regulations (such as the U.S. Clean Air Act and California Air Resources Board / CARB requirements), that apply to the products you buy and how you use them. Product pages and manufacturer documentation control over any general site language. By purchasing, you represent that you will use the products lawfully and accept full responsibility for legal compliance.

5. Assumption of Risk — Motorsport Warning

Warning: motorsport and vehicle modification can be dangerous and can result in property damage, serious injury, or death.

Aftermarket parts can change how a vehicle performs, handles, stops, and complies with safety and emissions systems. You expressly assume all risk associated with the purchase, installation, and use of products bought from JoyMachine, including risks arising during racing, track, off-road, street, and ordinary driving. To the fullest extent permitted by law, you release JoyMachine from any claim for personal injury, death, property damage, vehicle damage, or economic loss arising from product use, misuse, or installation.

6. Installation and Professional Service

Many products require professional installation, supporting modifications, tuning, or calibration to function safely and correctly. JoyMachine does not perform installation and is not responsible for installation work, labor charges, tuning, diagnostic costs, downtime, or any damage resulting from improper or incomplete installation. Follow the manufacturer's instructions and use a qualified professional where appropriate.

7. Warranties

Products may carry a limited warranty from their manufacturer. Any such warranty is provided by the manufacturer, not by JoyMachine, and is subject to the manufacturer's terms, conditions, and claims process. Except for any manufacturer warranty that applies, and to the fullest extent permitted by law, products are provided "as is," and JoyMachine disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

8. Orders, Payment, and Fraud Review

All orders are offers to purchase and are subject to acceptance, payment verification, product availability, fraud and risk review, and shipping restrictions. Placing an order does not guarantee availability or acceptance until the order is confirmed and fulfilled. We may refuse, limit, or cancel any order, including orders that appear fraudulent, that violate purchase limits, or that are placed by dealers or resellers without authorization. You agree to provide current, complete, and accurate billing and account information.

9. Shipping and Risk of Loss

Shipping timelines, rates, and methods are described on our Shipping Policy. Some items ship direct from manufacturers or distributors and may have lead times or freight requirements. Title and risk of loss pass to you upon delivery to the carrier. Claims for items damaged or missing in transit must be made promptly, with photos of the packaging and product, as described in the Shipping and Return policies.

10. Returns and Restocking

Returns are governed by our Return Policy. In short: contact us for approval before sending anything back, items must be unused and in original packaging, and approved returns are subject to a 25% restocking fee covering order processing and restocking, waived only where we shipped the wrong item or the item arrived damaged. Installed, used, deformed, or customer-damaged items, along with electrical, custom, special-order, fluid, and clearance items, are non-returnable. Refunds post 7–14 business days after we receive and inspect the return.

11. Intellectual Property and User Content

All content on the site, including text, graphics, logos, product photography, and the JoyMachine name and brand, is owned by JoyMachine or its licensors and is protected by intellectual property laws. You may not copy, reproduce, resell, or exploit any part of the site without our written permission. If you submit reviews, comments, photos, or other content, you grant JoyMachine a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content, and you confirm it does not violate anyone's rights. We may remove user content at our discretion.

12. Prohibited Uses

You may not use the site to break the law, infringe intellectual property, transmit malware, scrape or harvest data, interfere with security features, harass others, or send spam. We may suspend or terminate access for any violation.

13. Third-Party Links and Tools

The site may reference or link to third-party sites, manufacturers, and tools provided "as is" without warranty or endorsement. We are not responsible for third-party content, products, or transactions. Some links may be affiliate links through which JoyMachine may earn a commission.

14. Disclaimer of Warranties

The site and its content are provided "as is" and "as available." To the fullest extent permitted by law, JoyMachine disclaims all warranties, express or implied, and does not warrant that the site will be uninterrupted, secure, timely, or error-free, or that information on it is accurate, complete, or current.

15. Limitation of Liability

To the fullest extent permitted by law, JoyMachine and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for injury, death, vehicle damage, labor, downtime, or lost profits, arising from the site or the purchase, installation, or use of any product. Where liability cannot be excluded, our total liability is limited to the amount you paid for the product at issue.

16. Indemnification

You agree to defend, indemnify, and hold harmless JoyMachine and its owners, employees, and suppliers from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of products, or your violation of any law or third-party right.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.

18. Entire Agreement and Contact
